Important Notice
This document is a legally binding agreement between you and EliteSource.com.au. By accessing the EliteSource platform and submitting an event request, you confirm that you have read, understood, and agree to be bound by these Terms of Use in their entirety.
If you do not agree with any part of these Terms, you must not use the EliteSource platform.
Legal Review Notice
This document has been drafted with reference to applicable Australian and New Zealand law, including the Australian Consumer Law, the Privacy Act 1988 (Cth), the Spam Act 2003 (Cth), and the New Zealand Privacy Act 2020.
1. Introduction and Acceptance of Terms
1.1 These Terms of Use ("Terms") govern your access to and use of the EliteSource platform, website, and services located at elitesource.com.au (collectively, the "Platform"), operated by EliteSource.com.au ("EliteSource", "we", "us", or "our").
1.2 These Terms apply specifically to individuals and organisations accessing the Platform as event hosts, event buyers, or persons seeking event proposals ("you", "your", or "Event Host"). Separate terms apply to event providers, organisers, and venues.
1.3 By accessing the Platform, creating an account, or submitting an event request, you confirm that you have read, understood, and agree to be legally bound by these Terms, our Privacy Policy, and any additional guidelines or policies published on the Platform from time to time.
1.4 If you are using the Platform on behalf of a business, organisation, or other legal entity, you represent that you have the authority to bind that entity to these Terms, and references to "you" shall include that entity.
1.5 These Terms constitute a binding contract under the laws of Australia. Your continued use of the Platform following any amendment to these Terms constitutes your acceptance of the amended Terms.
2. About EliteSource, Our Role and Limitations
2.1 EliteSource operates exclusively as a communications intermediary and event request distribution platform. We provide the technology and infrastructure that enables Event Hosts to submit event requests and receive proposals from registered event providers, organisers, and venues (collectively, "Providers").
2.2 EliteSource is not an event management company, venue, event organiser, caterer, production company, or any other form of event service provider. We do not plan, manage, coordinate, deliver, or supervise any event.
2.3 EliteSource is not a party to any agreement, contract, arrangement, or transaction entered into between you and any Provider. Any such agreement is formed exclusively between you and the relevant Provider and is governed by whatever terms you and that Provider agree upon directly.
2.4 EliteSource does not endorse, recommend, certify, warrant, or guarantee the quality, accuracy, suitability, reliability, or fitness for purpose of any Provider or any proposal, quote, or service offered by any Provider.
2.5 The Platform operates as a free service for Event Hosts. EliteSource generates revenue from Providers, not from Event Hosts. This commercial arrangement does not affect the independence or neutrality of the request distribution process, nor does it create any obligation on EliteSource to ensure that a Provider performs its obligations to you.
Summary of Our Role
3. Eligibility to Use the Platform
3.1 To use the Platform as an Event Host, you must:
- Be at least 18 years of age;
- Have the legal capacity to enter into binding contracts under the laws of Australia or New Zealand;
- Be a natural person, incorporated entity, partnership, or other legal entity with authority to submit event requests; and
- Comply with all applicable Australian and New Zealand laws in connection with your use of the Platform.
3.2 The Platform is available to individuals and organisations located in Australia and New Zealand, as well as to international users seeking to organise events to be held in Australia or New Zealand.
3.3 You must not use the Platform if you are prohibited from receiving services from Australian entities under applicable law, or if your use of the Platform would violate any law applicable in your jurisdiction.
3.4 EliteSource reserves the right to refuse access to the Platform to any person or entity, in its sole and absolute discretion, without being required to provide a reason.
4. Identity Verification and Platform Access
4.1 EliteSource does not require you to create a user account, set a password, or maintain a persistent login profile to submit an Event Request. Access to the Platform's Event Request submission function is granted through a one-time email-based verification process as described in this section.
4.2 To initiate an Event Request, you must enter a valid email address into the Platform. EliteSource will send a four (4) digit verification code to that email address. You must enter the correct verification code into the Platform within ten (10) minutes of it being issued to proceed with your Event Request submission.
4.3 Each verification code is:
- Valid for a single use only and expires automatically upon use or upon the expiry of the ten (10) minute validity period, whichever occurs first;
- Sent exclusively to the email address you provide at the time of submission;
- Non-transferable and must not be shared with any third party; and
- Automatically invalidated if a new code is requested before the existing code has been used.
4.4 If your verification code expires before you enter it, you may request a new code by re-entering your email address into the Platform. EliteSource reserves the right to limit the number of verification codes issued to a single email address within a given time period to prevent misuse.
4.5 You represent that the email address you provide for verification is either your own personal email address or an email address that you are authorised to use on behalf of the business or organisation submitting the Event Request. You must not use an email address belonging to another person without their express authorisation.
4.6 You are responsible for the security of your email account and for ensuring that verification codes sent to your email address are not accessed or used by unauthorised persons. If you believe your email account has been compromised and an Event Request has been submitted through the Platform without your knowledge or authorisation, you must notify EliteSource immediately at support@elitesource.com.au.
4.7 EliteSource does not store passwords. Verification codes are single-use, time-limited, and are not retained by EliteSource after expiry or use. EliteSource retains only the email address associated with your Event Request submission, in accordance with its Privacy Policy and Section 10 of these Terms.
4.8 EliteSource does not operate a separate buyer dashboard or account management portal. Your interaction with the Platform is limited to the Event Request submission process and the subsequent email communications described in these Terms.
4.9 You agree to provide an accurate and current email address for verification. EliteSource is not responsible for any failure to receive a verification code, any missed communications from Providers, or any other consequence arising from an incorrect or inaccessible email address provided by you.
4.10 EliteSource reserves the right to decline to issue a verification code, or to invalidate a submitted Event Request, where it has reasonable grounds to suspect that the submission constitutes misuse of the Platform, fraud, or a violation of these Terms.
5. Submitting an Event Request
5.1 The Platform allows you to submit a structured event request brief ("Event Request") describing the nature, requirements, and specifications of an event you are seeking to plan or organise.
5.2 When submitting an Event Request, you must provide accurate and complete information, including but not limited to:
- Event type (e.g. corporate conference, wedding, birthday, anniversary, gala dinner, retreat, workshop);
- Approximate event date or date range;
- Location or preferred location in Australia or New Zealand;
- Approximate number of attendees or guests;
- Budget range or budget indication; and
- Any specific requirements, preferences, or scope relevant to the event.
5.3 You acknowledge that the accuracy and completeness of your Event Request directly affects the quality and relevance of proposals you receive. EliteSource is not responsible for proposals that are unsuitable, inaccurate, or incomplete where such outcome results from insufficient or inaccurate information provided by you.
5.4 By submitting an Event Request, you:
- Consent to your Event Request being distributed to Providers in accordance with the distribution process described in Section 6 of these Terms;
- Consent to your contact information being provided to Providers who receive your Event Request, for the purpose of enabling those Providers to respond to your request; and
- Represent that you have a genuine intention to organise the event described and are seeking legitimate proposals from Providers.
5.5 You must not submit an Event Request that is false, fictitious, misleading, or submitted for any purpose other than genuinely sourcing event services. Misuse of the Event Request process may result in immediate suspension or termination of your access to the Platform.
5.6 EliteSource reserves the right to decline to process or distribute any Event Request that, in its sole discretion, it considers to be inappropriate, incomplete, potentially harmful, or in violation of these Terms.
6. Event Request Distribution Process
How Your Request is Distributed
6.1 Upon successful submission of your Event Request, EliteSource will distribute your request to Providers registered on the Platform in two stages, as follows:
Stage 1, Priority Tier Distribution (Immediate)
6.2 Immediately upon submission of your Event Request, EliteSource will distribute your request to up to five (5) Priority Tier Providers. Priority Tier Providers are paid premium members of the EliteSource network who have been identified by EliteSource as relevant to your event type, location, and requirements.
6.3 You will receive an automated confirmation email to the email address associated with your account within a short time following submission. This confirmation email will:
- Confirm that your Event Request has been received and distributed to Priority Tier Providers;
- Summarise the key details of your submitted Event Request;
- Provide clear instructions on how to stop your Event Request from being distributed to additional Providers (see Section 7, Stopping Your Request); and
- Set out the expected timeline for Stage 2 distribution.
Stage 2, Standard Tier Distribution (After 48 Hours)
6.4 If you have not stopped your Event Request in accordance with Section 7 of these Terms, EliteSource will distribute your Event Request to Standard Tier Providers forty-eight (48) hours after the time of your initial submission.
6.5 Standard Tier Providers are Providers registered on the Platform who have not subscribed to the Priority Tier. Stage 2 distribution is intended to ensure that you receive a sufficient number of proposals even in circumstances where Priority Tier Providers do not respond to your request.
6.6 The total number of Standard Tier Providers notified in Stage 2 will be determined by EliteSource in its discretion, based on the availability of relevant Providers matching your event type, location, and requirements.
General Distribution Provisions
6.7 EliteSource does not guarantee that any specific number of proposals will be received in response to your Event Request. The receipt of proposals is dependent on Provider availability, interest, and responsiveness, which are outside EliteSource's control.
6.8 EliteSource does not guarantee that any Provider who receives your Event Request will respond to it, contact you, or submit a proposal.
6.9 The categorisation of Providers into Priority Tier and Standard Tier is based on their subscription status with EliteSource and does not reflect or imply any assessment of their quality, capability, reputation, or suitability for your event.
6.10 EliteSource reserves the right to modify the distribution process, including the number of Providers notified at each stage, at any time without notice.
Distribution Timeline Summary
- Immediately after submission: Up to 5 Priority Tier Providers notified. Confirmation email sent to you.
- Within 48 hours: You can stop further distribution via the link in your confirmation email.
- At 48 hours (if not stopped): Standard Tier Providers notified to ensure you receive enough proposals.
7. Stopping Your Event Request
7.1 You may stop your Event Request from being distributed to Standard Tier Providers (Stage 2 distribution) at any time before the forty-eight (48) hour window described in Section 6.4 has elapsed.
7.2 To stop your Event Request from progressing to Stage 2 distribution, you must follow the instructions provided in your confirmation email. The confirmation email will contain a clearly labelled link or mechanism enabling you to stop further distribution.
7.3 Stopping your Event Request before Stage 2 distribution does not affect the distribution that has already occurred to Priority Tier Providers under Stage 1. EliteSource cannot prevent Priority Tier Providers who have already received your Event Request from contacting you.
7.4 Once the forty-eight (48) hour window has elapsed and Stage 2 distribution has commenced, EliteSource is unable to prevent Standard Tier Providers who have already received your Event Request from contacting you. Stopping the request after Stage 2 has commenced will prevent any further distribution but will not reverse distribution already completed.
7.5 If you wish to withdraw all contact permissions from Providers who have received your Event Request, you must manage those communications directly with the individual Providers. EliteSource is not able to instruct Providers to cease contact with you after your contact details have been distributed.
7.6 You may request that EliteSource delete your Event Request and associated data from its systems by contacting EliteSource at support@elitesource.com.au, subject to EliteSource's data retention obligations under applicable law and these Terms.
8. Consent to Receive Communications from Providers
8.1 By submitting an Event Request, you explicitly consent to receiving communications from Providers who receive your Event Request. This consent includes:
- Email communications from Providers to the email address associated with your account, for the purpose of submitting proposals, requesting clarification about your event requirements, or following up on your Event Request; and
- Telephone communications from Providers to any phone number you choose to provide in your Event Request, if you have elected to include your phone number and indicated your preference to be contacted by phone.
8.2 The provision of your phone number in an Event Request is entirely optional. By voluntarily including your phone number, you consent to Providers contacting you at that number in connection with your Event Request. If you do not wish to receive phone calls from Providers, you should not include your phone number in your Event Request submission.
8.3 You acknowledge that once your contact details have been distributed to Providers in accordance with Section 6, EliteSource has no control over the manner, frequency, or content of communications sent to you by those Providers. Any disputes or concerns about communications received from a Provider should be directed to that Provider and, where applicable, to the relevant communications regulator.
8.4 You acknowledge that Provider communications may constitute commercial electronic messages within the meaning of the Spam Act 2003 (Cth) (Australia) or the Unsolicited Electronic Messages Act 2007 (New Zealand). By submitting your Event Request and consenting under this clause, you provide the requisite consent for the purposes of those Acts in respect of communications from Providers who receive your request.
8.5 If you wish to stop receiving communications from a specific Provider, you should:
- Use the unsubscribe mechanism included in that Provider's emails, where available; or
- Contact the Provider directly and request to be removed from their communications.
8.6 If you believe you are receiving unsolicited or harassing communications from a Provider, you may report this to EliteSource at support@elitesource.com.au. EliteSource will use reasonable endeavours to address complaints involving Providers on its platform, which may include removal of a Provider from the Platform. However, EliteSource cannot guarantee any specific outcome and is not liable for communications received from Providers.
Important Notice
Your consent to receive Provider communications is provided voluntarily by you when submitting an Event Request.
Phone contact is strictly opt-in. You will only receive calls from Providers if you provide a phone number in your submission.
EliteSource is not responsible for the conduct, frequency, or content of communications sent to you by Providers after your details have been distributed.
9. Quotes, Proposals, and No Guarantee of Outcome
9.1 Any proposal, quote, estimate, or pricing information submitted by a Provider in response to your Event Request is provided solely by that Provider and is not created, endorsed, verified, or approved by EliteSource.
9.2 EliteSource makes no representation or warranty that:
- Any proposal submitted by a Provider is accurate, complete, current, or fit for your purposes;
- The pricing contained in any proposal reflects market rates or competitive pricing;
- A Provider has the capability, licences, insurance, or resources required to deliver the services described in their proposal; or
- Any proposal submitted by a Provider will be honoured by that Provider.
9.3 You are solely responsible for evaluating proposals received through the Platform, conducting your own due diligence on Providers, and making your own independent decisions about whether to engage any Provider.
9.4 Any agreement to engage a Provider, including the terms of service, pricing, deliverables, payment, and dispute resolution, is a matter solely between you and the Provider. EliteSource is not a party to any such agreement and has no obligations arising from it.
9.5 EliteSource does not guarantee that you will receive any proposals in response to your Event Request, or that any proposals received will be suitable for your needs.
10. Data Retention
10.1 EliteSource will retain your Event Request data, including the content of your brief and any associated proposals or quotes received in response to your request, for a period of twelve (12) months from the date of submission ("Retention Period").
10.2 The retention of this data serves the following legitimate purposes:
- Enabling you to reference your prior event requests and received proposals within the Platform;
- Enabling EliteSource to improve its matching and distribution systems based on historical request data;
- Enabling EliteSource to respond to complaints, disputes, or inquiries relating to a submitted Event Request; and
- Complying with applicable legal and regulatory requirements.
10.3 Following the expiry of the Retention Period, EliteSource will delete or anonymise your Event Request data in accordance with its data retention policies and applicable law, unless:
- You have submitted a further event request, in which case the Retention Period will apply to that subsequent request; or
- Retention is required for a longer period under applicable law or for the purposes of resolving an ongoing dispute.
10.4 Your personal information is handled in accordance with EliteSource's Privacy Policy, available at elitesource.com.au/privacy-policy, and in compliance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). Users located in New Zealand are also afforded protections under the New Zealand Privacy Act 2020.
10.5 You have the right to request access to, correction of, or deletion of your personal information held by EliteSource at any time, subject to the exceptions set out in applicable privacy law and EliteSource's Privacy Policy. Requests should be directed to support@elitesource.com.au.
11. Communications from EliteSource
11.1 By creating an account and submitting an Event Request, you agree to receive the following categories of communications from EliteSource:
Service Communications (Mandatory)
11.2 EliteSource will send you essential service-related communications relating to your account and Event Request. These communications may include:
- Confirmation of your Event Request submission and distribution;
- Notifications relating to proposals or responses received from Providers;
- Reminders or follow-up communications relating to the status of your Event Request;
- Information about changes to your account, these Terms, or the Platform; and
- Security or account-related alerts.
Service communications are essential to the operation of the Platform and cannot be opted out of while you maintain an active account. They do not constitute commercial electronic messages within the meaning of the Spam Act 2003 (Cth).
Feedback and Platform Improvement Communications
11.3 EliteSource reserves the right to contact you for the following additional purposes:
- Requesting feedback on your experience using the Platform or on proposals received from Providers;
- Requesting feedback on events you have completed, for the purpose of improving the Platform's matching and quality assurance;
- Notifying you of updates, improvements, or new features on the Platform relevant to your use; and
- Contacting you where EliteSource identifies a potential issue with your account or Event Request.
These communications are considered part of EliteSource's legitimate service operations. You may request to opt out of feedback request emails by contacting EliteSource at support@elitesource.com.au.
Marketing Communications (Opt-in)
11.4 With your explicit consent, obtained at the time of account creation or submission, EliteSource may send you marketing communications including:
- Promotional offers, discounts, or incentives from EliteSource or its selected commercial partners;
- Information about new services, event categories, or Provider offerings available on the Platform;
- Curated content, guides, or resources related to event planning; and
- Newsletters or industry updates relevant to event planning in Australia and New Zealand.
11.5 Marketing communications will only be sent where you have provided your express consent at the time of registration or submission. You may withdraw this consent at any time by:
- Clicking the 'unsubscribe' link contained in any marketing email; or
- Contacting EliteSource at support@elitesource.com.au.
11.6 EliteSource will honour unsubscribe requests within five (5) business days in accordance with its obligations under the Spam Act 2003 (Cth). Unsubscribing from marketing communications will not affect your receipt of service communications under Clause 11.1.
11.7 All commercial electronic messages sent by EliteSource will comply with the Spam Act 2003 (Cth) (Australia) and the Unsolicited Electronic Messages Act 2007 (New Zealand), including by identifying EliteSource as the sender and including a functional unsubscribe mechanism.
12. No Endorsement or Verification of Providers
12.1 EliteSource does not conduct background checks, criminal history checks, reference checks, licence verification, insurance verification, or any other form of vetting or verification of Providers listed on the Platform, unless otherwise expressly stated in specific Platform features.
12.2 The presence of a Provider on the Platform does not constitute any endorsement, recommendation, certification, or warranty by EliteSource of that Provider's quality, reliability, integrity, legality, or suitability for your event.
12.3 You are solely responsible for conducting your own due diligence before engaging any Provider, including but not limited to verifying:
- The Provider's business registration, ABN, and legal standing;
- The Provider's relevant licences, permits, and insurance coverage;
- The Provider's references, portfolio, and previous client reviews; and
- The Provider's ability to deliver the services described in their proposal.
12.4 EliteSource strongly recommends that you enter into a written contract with any Provider you engage, specifying the services to be delivered, the pricing, the payment terms, cancellation conditions, and any applicable refund or liability provisions.
13. Limitation of Liability
13.1 To the maximum extent permitted by applicable law, including the Australian Consumer Law, EliteSource and its directors, officers, employees, contractors, and agents expressly disclaim all liability for:
- Any loss, damage, cost, or expense arising from or in connection with any agreement, transaction, or dealing between you and a Provider, including but not limited to a Provider's failure to deliver services, poor quality of services, cancellation, misrepresentation, or insolvency;
- Any inaccuracy, incompleteness, or misleading nature of any proposal or quote submitted by a Provider through the Platform;
- Any direct, indirect, incidental, special, consequential, or punitive loss arising from your use of or inability to use the Platform;
- Any loss arising from unauthorised access to or alteration of your Event Request or account data;
- Any technical failures, interruptions, errors, or omissions in the Platform or its systems; and
- Any communications sent to you by Providers after your contact details have been distributed in accordance with these Terms.
13.2 Where EliteSource's liability cannot be excluded under the Australian Consumer Law or other applicable law, EliteSource's total liability to you is limited, at EliteSource's election, to:
- Resupplying the relevant service; or
- Paying the cost of having the relevant service resupplied.
13.3 Nothing in these Terms excludes, restricts, or modifies any right or remedy you may have under the Australian Consumer Law, including any guarantee under Division 1 of Part 3-2 of the Australian Consumer Law, to the extent that such rights or remedies cannot be excluded by agreement.
13.4 The Platform is provided on an "as is" and "as available" basis. EliteSource makes no representation or warranty, express or implied, that the Platform will be uninterrupted, error-free, secure, or free from viruses or other harmful components.
Important Notice
EliteSource is a communications intermediary only.
We are not responsible for the conduct, quality, or reliability of any Provider.
Any contract you enter into for event services is directly between you and the Provider.
Nothing in these Terms affects your rights under the Australian Consumer Law.
14. Intellectual Property
14.1 All content on the Platform, including but not limited to text, graphics, logos, images, software, database structures, and the EliteSource brand name and trademark, is owned by or licensed to EliteSource and is protected by applicable intellectual property laws, including the Copyright Act 1968 (Cth).
14.2 Nothing in these Terms grants you any right, title, or interest in EliteSource's intellectual property. You may not reproduce, modify, distribute, publish, transmit, or create derivative works from any EliteSource content without prior written consent from EliteSource.
14.3 By submitting an Event Request, you grant EliteSource a non-exclusive, royalty-free, worldwide licence to use, store, copy, transmit, and display the content of your Event Request for the purpose of operating the Platform, distributing your request to Providers, and improving EliteSource's services. This licence does not extend to selling or commercialising your Event Request content.
14.4 Any proposals, quotes, or content submitted by Providers in response to your Event Request remain the intellectual property of the respective Provider unless otherwise agreed in writing between you and that Provider.
15. Prohibited Conduct
15.1 You must not use the Platform in a manner that:
- Violates any applicable law, regulation, or code of conduct in Australia, New Zealand, or your jurisdiction;
- Is fraudulent, deceptive, or misleading, including by submitting fictitious, false, or speculative Event Requests;
- Infringes the intellectual property rights of EliteSource or any third party;
- Involves scraping, harvesting, or collecting data from the Platform by automated means without EliteSource's prior written consent;
- Introduces viruses, malware, or other harmful code into the Platform;
- Attempts to gain unauthorised access to EliteSource's systems, data, or other users' accounts;
- Harasses, threatens, or abuses any Provider or EliteSource employee;
- Uses the Platform to solicit Providers for purposes unrelated to genuine event planning; or
- Circumvents EliteSource's platform by using contact details obtained through the Platform to engage Providers outside the Platform in bad faith.
15.2 EliteSource reserves the right to immediately suspend or terminate your access to the Platform, without notice or liability, if it reasonably believes you have engaged in any prohibited conduct described in this section.
16. Third-Party Services and Links
16.1 The Platform may contain links to third-party websites, services, or applications. EliteSource has no control over and accepts no responsibility for the content, privacy practices, terms of use, or availability of any third-party service.
16.2 EliteSource may use third-party service providers to deliver verification codes to your email address, including email delivery infrastructure providers. These providers act as data processors on behalf of EliteSource and are subject to appropriate data processing agreements. EliteSource does not share your personal information with these providers beyond what is strictly necessary to deliver the verification service.
16.3 Any third-party services accessed through or in connection with the Platform are used at your own risk. EliteSource recommends that you review the privacy policies and terms of any third-party service you access.
17. Privacy
17.1 EliteSource's collection, use, storage, and disclosure of your personal information is governed by EliteSource's Privacy Policy, available at elitesource.com.au/privacy-policy, and by the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
17.2 Users located in New Zealand have additional rights under the New Zealand Privacy Act 2020, which EliteSource observes in respect of personal information collected from New Zealand residents.
17.3 By creating an account and submitting an Event Request, you acknowledge that EliteSource will collect and use your personal information as described in the Privacy Policy and these Terms, including by sharing your contact information with Providers who receive your Event Request.
17.4 You have the following rights in respect of your personal information held by EliteSource:
- The right to request access to your personal information (APP 12);
- The right to request correction of inaccurate or incomplete personal information (APP 13);
- The right to make a complaint about EliteSource's handling of your personal information to the Office of the Australian Information Commissioner (oaic.gov.au); and
- New Zealand residents: The right to make a complaint to the New Zealand Privacy Commissioner (privacy.org.nz).
17.5 To exercise any of these rights, please contact EliteSource at support@elitesource.com.au.
18. Governing Law and Jurisdiction
18.1 These Terms are governed by and construed in accordance with the laws of the State of New South Wales, Australia, without regard to its conflict of law principles.
18.2 You submit to the non-exclusive jurisdiction of the courts of New South Wales, Australia, for the resolution of any dispute arising out of or in connection with these Terms or your use of the Platform.
18.3 For users located in New Zealand, nothing in this clause operates to exclude or limit any rights you may have under New Zealand law, including the Consumer Guarantees Act 1993, the Fair Trading Act 1986, or the Contract and Commercial Law Act 2017.
18.4 EliteSource acknowledges that the Australian Consumer Law and certain New Zealand consumer protection laws may apply to your use of the Platform regardless of any governing law provision. Nothing in these Terms operates to exclude those mandatory legal protections.
19. Dispute Resolution
19.1 If you have a complaint or dispute arising from your use of the Platform or these Terms, you must first contact EliteSource at support@elitesource.com.au and provide a written description of your complaint, including relevant supporting information.
19.2 EliteSource will acknowledge your complaint within five (5) business days and will use reasonable endeavours to resolve the complaint within twenty (20) business days.
19.3 If your complaint relates to a Provider's conduct or services, EliteSource will use reasonable endeavours to assist with communication but is not obligated to mediate, arbitrate, or resolve disputes between you and any Provider.
19.4 If your complaint cannot be resolved directly with EliteSource, you may refer the matter to:
- The Australian Competition and Consumer Commission (ACCC), accc.gov.au, for matters involving the Australian Consumer Law;
- The Office of the Australian Information Commissioner (OAIC), oaic.gov.au, for matters involving your privacy rights;
- Your relevant state or territory consumer protection agency; or
- New Zealand residents: The Commerce Commission (comcom.govt.nz) or the New Zealand Privacy Commissioner (privacy.org.nz) for relevant matters.
19.5 Nothing in this section limits your right to commence legal proceedings in a court of competent jurisdiction.
20. Amendments to These Terms
20.1 EliteSource reserves the right to amend, update, or replace these Terms at any time in its sole discretion. Amended Terms will be posted on the Platform with a revised effective date.
20.2 For material changes to these Terms, EliteSource will use reasonable endeavours to provide you with advance notice by email to the address associated with your account, or by a prominent notice on the Platform, at least fourteen (14) days before the changes take effect.
20.3 Your continued use of the Platform following the effective date of amended Terms constitutes your acceptance of the amended Terms. If you do not agree with the amended Terms, you must cease using the Platform.
20.4 EliteSource recommends that you review these Terms periodically. The current version will always be available at elitesource.com.au/terms-of-use.
21. General Provisions
Entire Agreement
21.1 These Terms, together with EliteSource's Privacy Policy and any other policies or guidelines expressly incorporated by reference, constitute the entire agreement between you and EliteSource with respect to your use of the Platform as an Event Host, and supersede all prior agreements, representations, and understandings.
Severability
21.2 If any provision of these Terms is held to be invalid, void, unenforceable, or illegal by a court of competent jurisdiction, that provision will be severed from these Terms and the remaining provisions will continue in full force and effect.
No Waiver
21.3 EliteSource's failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. A waiver is only effective if given in writing and signed by EliteSource.
Assignment
21.4 You may not assign or transfer any of your rights or obligations under these Terms without EliteSource's prior written consent. EliteSource may assign its rights and obligations under these Terms to a related body corporate, successor entity, or purchaser of its business without your consent.
Force Majeure
21.5 EliteSource is not liable for any failure or delay in performing its obligations under these Terms to the extent that such failure or delay is caused by circumstances beyond its reasonable control, including natural disasters, acts of government, telecommunications failures, or cyber-attacks.
Notices
21.6 Notices to EliteSource under these Terms must be sent in writing to support@elitesource.com.au. Notices from EliteSource to you will be sent to the email address associated with your account.
